The Full Court granted provisional leave to appeal to the Privy Council but made it conditional: the appellant must, within three months, enter security of $5,000 for prosecution of the appeal and payment of costs, lodge the respondent's taxed costs, and despatch the record; the respondent was permitted to issue execution for possession after 30 November 1947 provided the respondent entered security of $4,500 to abide by the Privy Council's decision; failure by the appellant to comply results in dismissal of the petition with costs.
