Given the binding preliminary agreement, the formal agreement became effective on signature, the cheque was properly presented under modern banking practice and was dishonoured when stopped by the drawer, and the stoppage/ dishonour amounted to a repudiatory breach entitling the plaintiff to accept the breach, terminate the contract and forfeit the deposits.
