Given the established prima facie case for winding-up and the need for genuinely independent provisional liquidators to pursue a rescue, the court refused candidates with recent partisan receivership appointments over significant Group assets (KPMG and RSM) because those prior roles created a real prospect of compromised objectivity and potential need for investigation of their prior conduct; the Deloitte candidates were independent and unobjectionable and therefore appointed as provisional liquidators.
