    Because the registered owner was ordered to hold the property on trust and to transfer it to the applicant on her attaining 18, the applicant had an equitable entitlement; the registered owner died without transferring and without any personal representative having obtained probate or letters of administration, and section 45 of the Trustee Ordinance empowers the court to vest the land in such a person, the court was justified in making a vesting order in favour of the applicant; removal of the trustee from the title was unnecessary for the vesting order.

    Given the unchallenged documentary evidence that the trustee was the purchaser-trustee, that he died in 1967, that no will or grant of representation exists and the trusteeship was never removed, the Court was satisfied that a vesting order under s45(e) was appropriate and granted the land to the applicant absolutely.

    The Court, satisfied that the named trustee was deceased, that no probate or letters of administration had been granted, that the applicant proved beneficial ownership by the registered succession instrument and that there was no one to serve, applied section 45 Trustee Ordinance to remove the deceased trustee and vest the entire legal estate in the applicant.
