Given the appellant's youth (15 at the time of the offence), favourable probation report, lack of prior record, employment prospects, and that he had been detained in the Training Centre for over three months and appeared to have learned his lesson, the Training Centre sentence was disproportionate; the appeal was allowed and the Training Centre order was set aside and replaced with a 12 month probation order with the appellant's consent.
