Leave to appeal was refused because (1) s22(1)(a) does not apply to awards of unliquidated damages even if the award exceeds $1,000,000, and (2) the matters advanced under s22(1)(b) did not raise points of great general or public importance; additionally the 1st Defendant had not been given a fair opportunity to address the factual basis of alleged negligence.
