A notice under Colonial Regulation 57(3)(b) is not invalid merely because served before the expiry of the 21 day period provided it expressly requires explanation for unauthorised absence exceeding 21 days and allows sufficient time to reply; where by the time an explanation is furnished the absence has exceeded 21 days the Governor (or delegate) may lawfully summarily dismiss under Reg 57(3).
