Because the applicant failed to comply with the court's directions to file an affirmation or statement confirming voluntary withdrawal and safety to return, and having conducted an anxious scrutiny of the Board's Decision on paper the Court found no error of law, procedural unfairness or Wednesbury unreasonableness, the Court refused the withdrawal and dismissed the application for leave to apply for judicial review for want of prosecution.
