Given the deceased 8th defendant's legal interest in the lands passed on death and only past costs survive, combined with unsuccessful attempts to find a representative and lack of real prejudice to the estate, the court exercised its discretion under Order 15 r 7 and r 15 to substitute the estate and allow the proceedings to continue in the absence of a person representing the estate, binding the estate to subsequent orders and judgments.
