- Citation
- HKSAR v. TSANG CHI SANG AND OTHERS
- Court
- Court of First Instance
- Case number
- HCMA1076/1999
A conviction founded on a fundamental factual error (here the misdating of a deposit) must be quashed; however, where an account‑holder has performed an essential step (such as entering a PIN into the handheld unit) the magistrate was entitled to find procurement of a bank record entry by deception even if the mechanical confirmation was completed by another; separate debits cannot be treated as a single composite debit but the court may convict on the basis of individual entries or vary the magistrate's decision under s119(1)(d).
