Deacons had not in fact ceased to act when they issued the summons; because Order 67 rule 6 applies only where a solicitor has already ceased to act, the Master lacked jurisdiction to entertain their summons and the Master's order must be set aside. The appeal is therefore allowed, but there were no special circumstances to retain Deacons on the record had they properly ceased to act and re-applied.
