As a matter of law a solitary visit can provide sufficient evidence to establish keeping under Section 139(b) if the evidence observed is consistent only with the premises being kept as a vice establishment; whether that condition is met is a question of fact. On the facts here (two independent but similar incidents, the premises' layout and lighting, the operational practices and cashier processing) the magistrate was entitled to infer persistent use and knowledge by the appellants; convictions were therefore upheld.
