An ex parte originating application under s.77E is a civil originating proceeding with no parties; the suspected person is not a party to that 'cause or matter' and thus not entitled to inspection rights under RSC O.63 r.4(2); the Master erred in granting wide leave under O.63 r.4(1)(c) to inspect all Crown materials, and that order is set aside; nevertheless the suspected person retains the right to inspect the originating application under O.63 r.4(1)(a) (and any order made in open court under O.63 r.4(1)(b) if applicable).
