The court exercised its discretion on costs and concluded that because the company had been wound up making any successful appeal effectively academic and because the costs potentially incurred were negligible such that proportionality militated against further contested inquiry, the proper order was no order as to costs for the discontinuance; however the costs of the argument on costs were to follow the event and be paid by the Plaintiffs to the 3rd Defendant, to be summarily assessed if not agreed.
