On the evidence, notably contemporaneous correspondence and parties' conduct, the court found the parties intended from the outset to share the GTC venture equally; that intention sufficed to recognize a 50% beneficial interest in favour of the plaintiff from 2004 and the trust/beneficial interest was sufficiently certain; consequentially the plaintiff was entitled to a declaration of 50% beneficial ownership (one share in GTC), to accounts and to consequential orders including transfer and enquiries; costs awarded to plaintiff.
