Although the appeal succeeded on the ground that a 'connected transaction' was not established, the Court held that the prosecution was nevertheless justified because the deceased's conduct had legitimately brought suspicion on himself; therefore trial costs are not awarded to the appellant but post-trial costs are awarded; a certificate for two counsel only is appropriate.
