The judge refused to discharge the jury because, on a fair reading, the prosecution opening remained within the terms of the indictment and any potential prejudice was neither irreparable nor incapable of being cured by judicial directions given the anticipated long and complex trial and the presumption that juries follow directions; therefore denial of discharge was a proper exercise of judicial discretion.
