Even if the extended concept of State acquiescence under General Comment No.2 is assumed applicable, the material did not establish that Sri Lanka or its officials consented to or acquiesced in the applicant's domestic violence; evidence of genuine legislative measures and efforts, and cultural/resource constraints, meant ineffective enforcement did not amount to State acquiescence under the Convention, so leave was refused.
