The Court held that the Licensing Examination established by s.7 (1995) is distinct from the pre-1995 Licentiate Examination and the applicant had not passed the Licensing Examination required for provisional registration under s.12, the Medical Council's reply was an informational response not a reviewable decision, the applicant's complaints were either unarguable or raised too late and therefore leave to apply for judicial review was properly refused; appeal dismissed.

The court concluded the pre-1995 Licentiate Examination is not the same as the Licensing Examination created by the 1995 amendments to the MRO, the applicant did not meet the statutory prerequisites for provisional registration under section 12 and was not within the transitional protection of section 35, the 7 July 2023 email was a reply to an inquiry rather than a reviewable refusal of an application, and the applicant has no reasonably arguable grounds for judicial review; accordingly leave is refused.

On 29 May 1999 the Vessel was still owned by GP Company; the permanent Cyprus register and the Bill of Sale/Sale Deed evidence demonstrated that title did not pass to BB Company until 1 July 1999; a provisional Belize registration does not defeat reliable documentary proof to the contrary; accordingly the Court had jurisdiction in rem and the defendants' motion to set aside the Writ and discharge the arrest failed.
