Although the judge omitted the lesser warning about conflicting co-defendant evidence, the conflict and each defendant's competing interests were obvious to the jury and the evidence against D.3 (fingerprint on the folder, negatives found in the factory, possession of films and conduct resisting entry) was such that the conviction would inevitably have been the same; therefore the proviso applies and the application for leave to appeal is dismissed.
