The court found no real danger that members of the Listing Committee who heard the First Instance Hearing had prejudged the applicants: the 24 July 1997 comments expressed legitimate concern rather than predetermination, so there was no disqualifying bias and judicial review was dismissed. The availability of internal review was relevant but unnecessary to decide once no bias was found; the court reiterated that judicial review is discretionary and should be granted only where the interests of justice require intervention.
