The magistrate erred by treating the appellant's splashing of tepid water as an assault and by failing to consider whether the appellant's subsequent actions amounted to reasonable self-defence; on re-hearing the court found the prosecution failed to displace the possibility of self-defence and the conviction was therefore unsafe and was quashed.
