The Court allowed the appeal because the convictions rested on provisions of the 2000 Code (paras 5.1, 5.2 and 4.2.2.2/4.2.3) which, as interpreted in Dr Kwong Kwok Hay, operate disproportionately to restrict lawful public health education and the dissemination of factual information; incidental promotional effect from such education does not suffice to sustain disciplinary convictions.
