The summons is dismissed because the statutory scheme in section 15 Jury Ordinance governs payment of the jury deposit (Order 3 r 5 cannot override it), inadvertence of counsel is an insufficient explanation for the excessive delay, and the decisive practical reason refusing a fresh exercise of the court's discretion to order a jury trial is that the 2nd defendant is no longer legally represented making a jury trial unsuitable.
