The court upheld the magistrate's finding that the job introduction was an act performed in the appellant's capacity as a bailiff and that, given the inextricable connection between the introduction and the loan request plus the appellant's demonstrated untruthfulness to the ICAC, the prosecution proved beyond reasonable doubt that the solicitation was on account of a public act; therefore the conviction under the Prevention of Bribery Ordinance was upheld.
