The court found that, applying s.17 NTO together with Chinese customary law (Qing Code) and expert evidence, Tang Yip Sang (through his estate represented by Tsang Yuet Mui) was the only eligible male successor to Madam Chong's estate; even if the 1948 assignment did not constitute a formal appointment, customary agnatic succession entitled him to the half interest in the specified lots, and the declaration was granted.
