The court allowed the defendants’ appeal and ordered security for costs because a company in liquidation is presumed unable to pay, the merits were sufficiently contested but not so weak as to preclude security, limitation and proprietary questions were unresolved on the material before the court, and the prima facie case for security under s357 Cap 32 was made; accordingly security of HK$500,000 was reasonable and necessary, with stay of proceedings until payment.
