The court refused the wide discovery and interrogatories because the classes were overly broad, not necessary for disposing fairly, and largely encompassed privileged communications or documents not shown to be in the plaintiff's possession, and because Re Fuld and litigation privilege protect drafting and pre-execution materials; PAO s7 relief was not justified on the facts. The limited production ordered was confined to non-privileged medical reports already deployed in open court (items 5-11 of Schedule 3) and the plaintiff was ordered to file an affirmation about the 2007 Codicil.
