The Court upheld convictions because the judge reasonably inferred D1 was the getaway driver and party to the robbery from CCTV, possession of keys, timing and implausible defence explanations; however the re-test order was set aside because the judge lacked statutory power to make it under s72A(1)(a) of the Road Traffic Ordinance.
