Applying the real‑possibility test to objective facts — long‑standing acquaintance from school, overlapping employment at the same company, ongoing business contacts and the highly controversial and determinative nature of the expert's opinion — a fair‑minded and informed observer would conclude there was a real possibility of bias; therefore the Lands Tribunal's refusal to recuse the member was erroneous and must be set aside, and leave to appeal granted.
