At the time the writ was issued there was a reasonable prospect that the plaintiff could recover in excess of the District Court jurisdiction because a substantial claim for future loss of earnings was supportable by her psychiatric condition then; ECC payments and the plaintiff's later improvement did not negate that reasonable prospect, therefore the costs order nisi was properly varied so that costs are to be taxed on the High Court scale.
