The Tribunal held that auditing/accountant fees incurred to verify the accounts are not recoverable from the Respondent because the audit was an exercise the Applicant would have undertaken in any event and the auditing work was interwoven with litigation so the recoverable litigation costs cannot be severed; accordingly costs were apportioned with the Respondent ordered to pay part of the litigation costs but accountant fees disallowed.
