The court accepted the 1st Respondent’s credible explanations (ancestral character of lands, low realisable value, obligation to bear repair/maintenance costs, lack of means, long separation) and concluded on the balance of probabilities that he did not possess the requisite intention to defeat the Petitioner’s claim; therefore the rebuttable presumption under s17(3) was rebutted and the Section 17 application failed (no need to decide bona fides of 2nd Respondent).
