Preparatory work referred to in s.2(1)(b) of the Ordinance is confined to work on the site where the construction (reclamation) is to take place (or its immediate vicinity); work at a separately located Borrow Area not contiguous or adjacent to the reclamation site is not "construction work" under s.2(1) nor a "construction site" under Regulation 2, therefore the magistrate's conviction cannot be sustained.
