A court may only order forfeiture of a surety's recognizance in the surety's absence if satisfied that the surety received adequate notice under principles akin to s29(2) methods of service; applying that standard, the court refused forfeiture in case No.195 for lack of proper service and ordered forfeiture in case No.264 where the notice was left with a brother at the surety's last known address.
