On acquittal the court may order payment from public revenue of costs of the defence under s73A as exercised through s43, but recoverable costs are limited to expenses properly incurred in or about the defence and do not include costs incidental to arrest; accordingly the prosecution must pay appellants' defence costs for the District Court trials, the Court of Appeal case stated appeals and all proceedings before this Court, limited to two counsel, while arrest-related costs claimed by Mr Chan are excluded.
