The Court of Appeal held that, notwithstanding invalid owners' meetings and allegations of impropriety in tendering, the manager was contractually authorized to carry out the repairs under the Deed and Management Agreement, the works were performed and certified and the price was fair and reasonable; accordingly the appellant was entitled to recover HK$96,300 plus interest and costs, and the District Court judgment was set aside.
