The applicant's late withdrawal of his renewal application and conduct in pursuing multiple unsuccessful applications after a prior refusal and warning amounted to a serious waste of court resources and an abuse of the appellate process; accordingly, exercising the power under s.83W CPO, the court ordered that two months of the time the applicant had served while awaiting the appeal would not be counted towards his sentence.
