The court allowed the applicant's withdrawal because it was satisfied the withdrawal was voluntary and that the applicant understood the consequences, including that the Board's decision would remain in force and that she might be refouled.

The Notice of Motion was dismissed because the applicant failed to identify any question of great general or public importance under s22(1)(b) HKCFAO and his allegations were vague, unsupported and fact‑specific; there was no basis to grant leave under the 'or otherwise' limb; non‑compliance with Practice Direction 2.1 and failure to identify any specific error in the Judgment reinforced dismissal.

The applicant raised no valid ground challenging the Director's decision and there was no reasonable prospect of success because the Director lawfully concluded there was no significant change of circumstances since the prior determination; accordingly leave to apply for judicial review was refused and a Restricted Proceedings Order was made to prevent further abusive repetitive litigation given the procedural history and the applicant's absence.
