The court exercised its discretion to lift the 42-day legal aid automatic stay as the applicant's late application amounted to an abuse of process; on the merits the adjudicator's decision satisfied the enhanced Wednesbury standard, contained no error of law or procedural unfairness and the applicant had no realistic prospect of establishing a substantial risk of torture, CIDTP, persecution or violation of right to life on return, therefore leave to apply for judicial review was refused.
