Where a prospective hirer (here a police officer) instigated conduct that was itself unlawful (flagging/attempting to hire in a prohibited area), the driver's subsequent refusal to comply with directions was excused; the illegality of the hirer deprived the prosecution of the actus reus necessary to sustain a conviction under regulation 27 despite evidence of mens rea.
