The Court held that the trial judge was correct to admit the plaintiff's oral evidence of the agreed boundary because the Deed Polls contained no verbal boundary description and the two attached plans were inconsistent and unreliable; s.26A was not engaged because the registered plan was an original; the admission of unpleaded oral evidence was within the trial judge's discretion and any surprise could have been met by adjournment; appellate intervention was unwarranted on findings of fact or weight of evidence. Accordingly leave to appeal and stay were dismissed.
