On the evidence, the Plaintiff's adopted daughter had no actual authority to sign the provisional agreement and there was no representation by the Plaintiff to the Defendant that could give rise to ostensible authority; accordingly the provisional agreement is not binding on the Plaintiff and is not registrable at the Land Registry.
