The court declared that, pursuant to the retention of title clauses in the contracts and the buyer's failure to pay the outstanding balance, legal title to the five buses remained with the Plaintiff despite registration in D2’s name; D2 therefore holds the buses on trust for the Plaintiff and must take all reasonably necessary steps to effect transfer to the Plaintiff or its nominee; if D1 neglects, refuses or cannot be found, the Registrar may execute necessary transfer documents under s25A Cap 4A; costs were ordered against D1 and no costs between Plaintiff and D2.
