The agreement was unenforceable and the plaintiff was not entitled to specific performance because the written agreement was one‑sided and too vague as to completion (no consideration and open‑ended timetable), the plaintiff had given an oral assurance to complete by end of August 2011 which she failed to perform and which the court found to be untrue, therefore the defendant was entitled to repudiate, have the registered charge vacated and pursue damages and costs.
