The application for leave to apply for review was refused because, on the evidence before the magistrate and in the absence of grave aggravating circumstances or evidence of means, the fine of $500 was not manifestly inadequate; immigration status was irrelevant to increasing sentence for a reg.12(3) offence and that offence, although more serious than failure to produce identity, did not necessarily warrant immediate custody on first conviction.
