The court refused the application because it lacked jurisdiction: s158 does not authorize orders to register documents with the Companies Registry; there is no free‑standing inherent jurisdiction to compel the Registrar to register documents; s348 is the exclusive statutory route which requires an antecedent refusal by the Registrar and no such decision existed here; accordingly the summons was dismissed and costs were ordered to the 2nd defendant on an indemnity basis.
