The Court held that the judge below's finding did not establish unequivocal contractual acceptance of the machine on 30 March; the 3 April 2000 notice, which was not validly challenged under the procedural rules and was given to Mr Lee who had ostensible authority, was a valid and sufficient rejection within the contractual period, entitling the plaintiff to return of the HK$100,000 deposit with interest and requiring the setting aside of the judgment below.
