After a full review of the evidence the court concluded the magistrate had underestimated the relevance of collateral matters and, given the inherent evidential difficulties of a brief sudden affray and the inconsistencies in the police evidence, a lurking doubt remained; accordingly the determinations of guilt were unsafe and the appeal was upheld.
