The court accepted plaintiff's credible evidence that she paid the purchase price, all mortgage instalments and ongoing outgoings in reliance on an express arrangement that the defendant hold legal title as a formality and would assign it on request; such detrimental reliance makes it unconscionable for defendant to deny plaintiff's beneficial interest, therefore the defendant holds the Subject Property on a common intention constructive trust in favour of the plaintiff.
